All accidents and near misses must be investigated. The reason for this is to prevent a reo-ccurrence not to apportion blame.
If a serious accident occurs, WorkSafe New Zealand must be notified immediately. An investigation must be completed within seven days.

WorkSafe New Zealand will also conduct an investigation of their own. Their findings will be presented as evidence in court should a prosecution occur.
It is illegal under current legislation to insure against fines and because fines have increased substantially, defended hearings may become more of an option for some companies. Professional, independent accident investigation is essential in these cases.

An independent review of the incident by a qualified investigator can help to bring a balanced viewpoint into what is often a very stressful situation for all parties.
